ItTalk Terms of Service

1. Overview and Acceptance

These Terms of Service ("Terms") are a legal agreement between you and Hangzhou Yuling Intelligent Technology Co., Ltd. ("Company," "we," "us," or "our") governing your access to and use of the ItTalk mobile application, account services, invitation-code access, pet profile features, pet photo upload, AI pet avatar generation, questionnaire features, AI conversation features, app-based voice interaction features, app-based device connection and status display, device-synced data display, help-mode configuration, customer support, and related online services (collectively, the "App Service").

These Terms do not govern the physical hardware product itself, hardware manufacturing, hardware safety, hardware warranty, hardware returns, hardware repair, hardware delivery, crowdfunding commitments, or hardware operating instructions. Those matters should be covered by separate device terms, purchase terms, warranty terms, product manuals, crowdfunding terms, or other product notices where applicable.

By creating an account, entering a valid invitation code, clicking "I Agree," accessing the App Service, or otherwise using the App Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App Service.

3. Eligibility

The App Service is intended only for users who are at least 18 years old. You may not create an account or use the App Service if you are under 18.

You are responsible for ensuring that your use of the App Service complies with applicable laws where you reside.

4. Key Definitions

"Account" means an account created or accessed through a phone number, verification code, invitation code, or other login method supported by the App Service.

"Invitation Code" means a code generated, assigned, or shared for access to the App Service. Each invitation code is intended for one-time use unless otherwise stated in the app.

"Pet Profile" means pet-related information that you enter, upload, or manage in the App Service, including pet name, type, birthday, photos, questionnaire answers, and preference or personality information.

"AI Pet Avatar" means an AI-generated image, animation, action, widget, or other virtual pet representation generated through the App Service.

"AI Output" means text, images, animations, voice, pet-like expressions, activity interpretations, or other content generated by AI models or related systems.

"Device-Synced Data" means data received by the App Service from a compatible connected device and displayed or used within the App Service, such as connection status, battery level, motion trends, sleep status, activity changes, and status descriptions.

5. App Service and Feature Boundaries

ItTalk is an AI-assisted pet companionship and virtual pet application for adult pet owners. Features may include invitation-code access, account login, pet profile management, pet photo upload, AI pet avatar generation, questionnaires, text or app-based voice interaction, app-based device connection, device-synced data display, help-mode text configuration, notifications, and support.

Available features may vary by app version, operating system, region, permissions, network conditions, account status, device compatibility, and third-party service availability.

Some features may be beta, experimental, limited-release, or invitation-only. We may modify, suspend, or discontinue features where permitted by law.

6. Veterinary, Safety, and AI Disclaimers

The App Service is not veterinary care, medical care, emergency service, pet rescue service, or professional health service. It does not provide veterinary diagnosis, treatment, medication advice, emergency response, or guaranteed safety protection.

AI Outputs are generated by automated systems and may be inaccurate, incomplete, delayed, or inappropriate. AI pet-like expressions do not represent your pet’s actual thoughts.

If your pet shows signs of illness, injury, distress, abnormal breathing, seizures, persistent behavior changes, appetite changes, or other concerning symptoms, contact a qualified veterinarian or emergency pet-care provider.

7. Invitation Codes

The App Service may require a valid invitation code before registration or access. Once an invitation code is successfully verified, it may be marked as used even if you do not complete the full registration process.

Registered users may receive invitation codes to share with others. Unless otherwise stated, each user may receive three invitation codes. Invitation codes may not be sold, transferred for compensation, abused, or used for automated or fraudulent registrations.

We may revoke, limit, or change invitation code rules at any time to control service cost, prevent abuse, or support beta testing.

8. User Content and AI Generation

You may upload pet photos, provide pet profile information, answer questionnaires, enter text, use app-based voice input, and submit other content to the App Service ("User Content"). You represent that you have the rights and permissions necessary to submit User Content.

AI pet avatar generation depends on image quality, pet visibility, model capabilities, network conditions, and service availability. We do not guarantee that any AI-generated result will perfectly match your pet or meet your expectations.

We may reject or ask you to re-upload photos or other content if the content is unclear, incomplete, not pet-related, unsafe, unlawful, infringing, or unsuitable for generation.

9. App-Based Device Features and Help Mode

If you connect a compatible smart collar or other device to the App Service, the App Service may display app-visible connection status, battery level, motion trends, sleep status, activity changes, status descriptions, or other Device-Synced Data.

Device-Synced Data may be delayed, incomplete, unavailable, or inaccurate. It is for everyday observation and companionship reference only.

If help mode is supported, you may configure help-message text or related app settings. The App Service may send such configuration or commands to a compatible connected device. Help mode is an auxiliary reminder feature only and does not guarantee that a lost pet will be found, that nearby people will hear or respond, or that any emergency will be resolved.

If you include phone numbers, addresses, names, or other personal information in help-message text, you are responsible for assessing the privacy and safety risks of that information being played, shown, or shared.

10. Fees, Purchases, and External Links

The App Service may offer free features, invitation-code benefits, paid generation, generation credits, premium style packs, action packs, widgets, Dynamic Island or desktop widget features, subscriptions, smart-collar purchase links, or other paid features. Pricing, benefits, expiration periods, refunds, and purchase terms will be displayed in the app or on the relevant purchase page.

If you purchase through an app store, external website, crowdfunding platform, or other third party, that third party’s terms and policies may also apply. We are not responsible for third-party websites or services that we do not control.

11. License to User Content

You retain the rights you have in your User Content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, transmit, and create derivative AI Outputs from User Content solely as needed to provide, maintain, secure, and improve the App Service and as otherwise described in our Privacy Policy.

12. Acceptable Use

You may not use the App Service to violate law, infringe rights, harass others, upload illegal or harmful content, reverse engineer the App Service, interfere with security, scrape or harvest data, abuse invitation codes, submit false information, or attempt to manipulate AI systems into generating unsafe or unlawful outputs.

13. Intellectual Property

The App Service, software, interfaces, trademarks, logos, designs, models, workflows, documentation, and other materials provided by us are owned by us or our licensors and are protected by applicable intellectual property laws. Except as expressly allowed, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the App Service.

14. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the App Service, you also agree to the practices described in the Privacy Policy.

15. Service Changes and Termination

We may modify, suspend, or discontinue the App Service or any feature where permitted by law. We may suspend or terminate your access if you violate these Terms, create risk, abuse the App Service, or use the App Service unlawfully.

16. Disclaimer of Warranties

To the maximum extent permitted by law, the App Service and AI Outputs are provided "as is" and "as available." We disclaim warranties of accuracy, reliability, fitness for a particular purpose, uninterrupted availability, and non-infringement, except where such disclaimers are not allowed by law.

17. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or pet-related outcomes arising from or related to your use of the App Service.

18. Governing Law and Disputes

These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law rules, except that mandatory consumer protection laws in your place of residence may also apply. The parties will attempt to resolve disputes through good-faith discussions. If a dispute cannot be resolved, either party may bring the dispute before a court with jurisdiction under applicable law.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the App Service or other reasonable means. Your continued use after the effective date means you accept the updated Terms.
